We manage a property that was damaged in the recent gas blast in Shaw.

The tenant was evacuated and placed in temporary accomodation by the council. The tenant is unable to return to the property until works are complete, because the property is nto accessible for safety reasons.

The tenant has stated throughout that she wants to move back in to the property once works are complete.

Now that the works have been completed, the tenant states that she does not want to move back in. We have told her that she must give one month notice in writing and will be charged rent for the period of the notice in which the property is habitable.

She has still not sent us her notice in writing. She has removed all her belongings from the property, but refuses to surrender the key. She refuses to do so on the grounds that she was one week into the month rent she had paid when the explosion occured. She beleives that she is entitled to 3 weeks rent to be reimbursed to her.

We beleive that she is obligated to pay for the notice period and therefore owes us rent.

please could you advise on the rent and notice issues?
