Notice to leave due to disrepair
I have a student tenant who wishes to terminate her tenancy early because of disrepair issues in the property. 6 tenants share the property. One of the two bathrooms/WC facilities is unfit for use according to the Local Authority. The basement floor where the bathroom is located appears to be damp. The property is a registered HMO. The landlord is also in dispute with the LA with regards to some grant work done to the flat roof extension in the basement. I believe the bathroom is located in this extension.
My Student has signed a tenancy agreement on the 20th May 2011 to rent the property, this agreement does not have a rental period, no start or end date, agreement does however state that the rent is 240 per month per person, £100 per month during July and August. There is no break clause.
My student has given notice of her intention to leave and received a letter from landlord’s solicitor advising her that they have seen the contract which runs from 1st Sept 2011 to 30th June 2012. The solicitor then goes on to say that the following ‘in the circumstances our client maintains that you are responsible for the rent until the 30th June 2012 and if you are unsure about your legal position please seek independent legal advice.
I would appreciate your thoughts on this matter.
