I have recently had a change of tenancy in a property and found a alarming amount of rising damp, which had remained unreported by the tenant. After investigations and consulting an expert on damp it appears that the problem has probably been caused by an adjacent property. The adjacent property had a major long term water leak which was discovered around four months ago and it appears that the excessive amount of water that has soaked into the ground has caused the damp proof cause to fail. I now face a bill of around 2,000.00 to fix the problem. The question is should I pursue the adjacent properties insurance for the repair costs? What is the legal position on this issue?
