New Leaseholder in Block not disclosing letting information to us or bank / solicitor
I am the company secretary of the 5-flat-block management/freehold Company (I am also the Leaseholder of 1 flat). Recently one of the flats was sold and I am having some difficulties with the new Leaseholder (who automatically becomes a Director of the Company):
1) She has bought the property on a normal residential mortgage but has immediately let out the property. Her solicitors are not aware of this (and presumably not her bank) and she has not asked us, as the Freeholder, permission. In fact when I spoke to her the first time on the phone she denied she was letting it out and said she lived there. She also repeated this at our recent AGM and only admitted that she was in fact letting it out and did not actually live there, after I pointed out that I had just spoken to her tenants. Apart from seemingly not being very trustworthy for a Company Director is this just a matter between her and her mortgage provider or does it have implications for the Freehold Company and therefore should I inform her bank?
2) She has so far refused to provide her residential address which makes it impossible to register her as a Director of the Management/Freehold Company with Companies House.
Is there anything that can be done or do we just have to accept the situation?
3) On a related point another Leasholder has just stopped his twice yearly Service Charge Standing Order without informing us why. It is 3 months late now. However, once again he has not left a forwarding address. Would any of his (or her) banks/lawyers/property agents have any duty to provide contact details to us or have they rather the duty to keep that information confidential? How else could we track him / her?
