I have a tenant to whom we served an S21 notice that expires 17th Jan 2010.
The tenant left this month, giving only 9 days notice. I thought I was entitled to one months notice (that is what the tenancy agreement states), but want to be sure of the legal position.
The deposit is not "protected" as the tenancy started 2004. The tenant asked for a full refund of the deposit but I felt the notice period was unreasonable and so have witheld half, which actually means she has paid for 10 days when she wasn't living there and we have forgone about 2 weeks of the notice to which we are entitled.
She is starting to dispute this and before we get too embroiled I just want to be certain that we are in a strong position.
