We have a property that is in 8 flats over three floors. Seven of these are self contained. There is one flat, for one person only, that includes its own kitchen but the tenant has to use a shower and w.c. on the floor above. The shower and w.c. is for his use only and is not shared by any other person and in fact he locks it with his own key. Licensing of HMOs is not required where all flats are self contained.
The local authority maintain that we need to license this property just because of this one flat but we maintain that as nothing is shared a licence is not required.

Your opinion would be much appreciated.
