I need some advice about housing benefit payments when a tenant gets taken in to custody.

Bolton housing benefit are demanding repayment of 3 months benefit because our tenant was arrested, remanded in custody and has since been given a prison sentence.

As soon as I was made aware of the situation, I served a section 21 notice and I have since obtained a written statement from the tenant saying that he wants to give up the tenancy so the landlord has agreed to terminate from the date.

I am aware that the local authority has an obligation to pay benefit whilst a tenant is in custody but I am unsure as to the extent of their responsibilities.

Could you please advise
