Accident in the rented property

A property has been recently let. The bannister rail on the stairs had not been fitted. The tenant has fallen down the stairs and broken her ankle. The tenant was made aware at the time of moving into the property that the bannister rail had not been fitted and was happy to move into the property without the rail. The letting agent stated that it is not a legal requirement to have a bannister rail. Is the tenant able to bring a claim against the landlord, for loss of earnings or anything else?
