Tenant Holding Deposit?

Hi,

I understand that in Scotland, any tenant charges apart from rent and the deposit are now unlawful.

However, in the UK, letting agents are all charging a holding deposit. So how does it work in Scotland when a prospective tenant shows an interest in a property, the letting agent pays for the credit checks, and then the tenant backs out? Is there any way to lock the tenant in before paying out for the credit checks?

I ask because I understand there is growing pressure to adopt this practice in England as well, and also I would like to make zero tenant charges a selling point of my letting agency.
