In need to help evicting tenant. She has told me she cannot afford to pay rent as her benefits have been stopped. She openly told me she wants an eviction notice/court order so she can get housing from council.

The tenancy is on a periodic term and has been for almost a year. She been a tenant for a few years.
I have issued section21 notice via recorded delivery twice.

The problem is i havent registered her deposit. What can i do, ive heard mixed opinions about this but no certainty.

I can use the accelerated possesion order via courts but inthink they will say my section 21 is invalid as deposit not registered. Is this true.

One advantage is shes will to work with me for court order as she wants that.

Should i return deposit and then issue section 21 if so how can i prove deposit is returned, or maybe draw up another agreement and back dated with no deposit.

Please help im stuck and confused.
