DOG FOULING!

I own a terraced flat in Tooting with a small narrow garden adjacent to the garden next door. The dog next door's continually goes into my tenants' garden and fouls! Despite numerous conversations/texts with the man next door he does nothing to stop the dog. We have contacted the Council Environmental Dept who visited the property but said the problem didn't constitute air pollution. What is my legal position or can and I might loose my tenant over it? As we are jointly responsible for the fence between the properties I have built half of it to a high standard whereas he hasn't and the dog is getting through his broken fence. Many thanks in advance for any help.
