Joint AST, relationship breakdown, one tenant has moved out and signed a Deed of Transfer of Tenancy to incoming tenant and remaining tenant. Have carried out an inventory property inspection and there are some items of damage caused by pets (cat and rabbit). Remaining and new tenant have agreed to rectify these items before there anticipated move out date next June 2014, we have written and confirmed this agreement. The Leaving tenant is the lead tenant for the DPS deposit and we understand that the deposit cannot be transferred to the remaining tenant but must be paid back to the lead tenant. A new deposit needs to be lodged for the remaining tenants. Our concern: is the agreement of the remaining tenants to rectify damage enforceable in the future?
