A tenant within a single tenancy agreement is leaving. He understands that he is liable to continue to pay rent until a new tenant is found as the other two tenants are remaining in the property. Due to the Christmas break, the remaining tenants have not yet advertised the room and do not intend to look for a new tenant until they are settled back after Christmas. The tenant is leaving next week so is concerned there will not be an urgency on the other tenants to find a replacement if he is still liable for the rent and not there to push them. He has advertised his room and had viewings without the others present and has potential people who would take over the tenancy. He has told them that they would have to be approved by the current tenants. Unfortunately, the remaining tenants are not happy that he has done this in their absence, have asked him to remove the advert and cancel all future viewings. He is not happy as he thinks they will now delay finding a new tenant and he will have to pay rent longer than he may have needed to. What rights does he have? the tenancy is a single assured short hold one so they are jointly and severally liable. If the other tenants fail to find someone in a realistic timescale, having refused to allow the 3rd tenant to look in their absence, are we justified in charging them the rent until they fill the room and not the tenant who is leaving? What rights does the person leaving have in this situation?
