I have just have just been informed that I have been sued for non payment of maintenance fees at a property that I have been letting for the past 6 years. I have always used a management company as I live abroad for most of the year. My contract states that tenants are responsible for all charges at the premises either directly or by way of service charges. It also states in another paragraph that tenants are responsible for passing on to the landlords agent any notice served on the premises. I contacted the management company that sued me for unpaid fees and asked them why I hadn't been informed about the action before it was taken. I was told that numerous letters had been sent to the property and visits were made to the property every week over a 2 year period. Nobody ever opened the door and no response was made to the letters. As they couldn't contact me they decided to take legal action. I knew nothing of this until my mortgage company contacted me to tell me what had happened. I am furious that this has happened I have never been in debt in my life and am sure there will be consequences for my credit history. But I am unsure how to proceed obviously I have paid the bill cost and fees included, but am I right to think that this is totally my agents fault, I need to know where I stand before I contact them.
