1. Tenancy agreement ends in May. Tenants have not replied to my request ten days ago whether they want to stay or move on.
2. My agent is very reluctant for me to serve section 21. He is trying to scare me by saying I cannot market the property without the tenants consent. I know that is not true.

Question - Is it advisable for me to serve section 21 now? This must be done before 15th March if I am not to miss the deadline . Agent says it will scare the tenants off. I do not want a situation where there is a delay, they do not leave, and I am faced with a periodic tenancy because of the confusion surrounding that regarding council tax liability and deposits. I also need to look for new tenants if they choose to go.

Since I can not force tenants to sign a tenancy agreement, and do not wish to lose out if they suddenly decide to go which again the agent is threatening they can do without notice and there is nothing I can do about that, I would like to end the current tenancy properly and start a new one should they decide to stay on.

He also says I can not re reference existing tenants.I need to do that in order to get the tenancy protection insurance. What's more, he was very reluctant to give me identity information of the tenants at the start of the tenancy. I forced his hands into giving me the details. I still do not know the immigration status of one of the tenants and do not wish to be fined under the proposed new legislation.

I do not know whose side the agent is on and would like to take matters into my own hands. Am I jumping the gun here?
