I have had some damage caused to the front door of one of my properties which required the panel to be replaced. Now I am seeking the costs from the tenant.

However, it has been pointed out the the wording in the AST agreement may provide for a 'get out clause'. The reason being is that the damage was caused deliberately by someone living with the tenant but the wording of the agreement only specifies deliberate damaged caused by the tenant or careless/negligent damage by the tenant or someone else. The wording does not cover deliberate actions by someone living with or visiting the tenant.

Section B, para 5
"Repair any damage that you have done deliberately or that was caused by the neglect or carelessness of you or anyone else living in or visiting the property"

Am I reading this wrong?

Criminal action was dropped as she would not give evidence against her partner so the only recourse I have is a civil claim against her (can't trace the ex).

Anyone got experience of this problem?
