hola, we currently live in Spain part of the time. We have damage to the boundary wall/fence on each side of the rear garden of a house we own in Swindon, caused by February's strong winds. The houses are terraced and the deeds are ambiguous, stating house owners are liable for boundary maintenance but not specifically.
It seems reasonable that house owners share the liability with their immediate neighbour that the damage is between?
On one side they are happy to do this. On the other side they are being evasive and unwilling. How can we get this neighbour to share repair cost? Should our landlord's insurance cover it all then request share from neighbours, or should they cover us 50/50 and we chase the neighbour through small claims court?
Please advise.
