HMO Planning permission

from 1st october 2010 to 15th May 2012 the law permitted development rights that introduced the then new right to change a premises from a dwelling to an HMO without planning permission.
I converted this dwelling in the summer of 2011, and therefore i did not seek planning approval.
Now i am in the process of obtaining a license to be a registered HMO, and now the council are asking for planning application/approval even though i have submitted evidence to the fact that it was converted within the legal time frame.

Do i go through the whole process of providing plans and planning applications costs, or go to court..?
