Hi there,
my tenant cut back ivy that had grown over the neighbour's fence on both sides (originating in a third party's garden). The fence was very dilapidated anyway, and was obviously weakened by my tenant's gardening efforts. The neighbour has now replaced her fence, and wants me to pay half. But I don't think I have any liability for her fence even though my tenants cut back the ivy on their side. I could offer a goodwill gesture. Can you give me a steer regarding the legal position and whether it would be legally sensible to offer anything?
