Liability for Council Tax when a tenant leaves prematurely

My tenant disappeared during the periodic phase of a standard AST tenancy - the first I knew was when I got the bill for council tax. According to the AST the tenancy ends with one months notice from the next rent payment day, and thus I strongly believe that the tenant is liable for council tax until that end date. But the council disagree and have just issued a court summons to me.

What facts (legislation etc) can I go to court armed with? Or do I just have to pay up - knowing the councils position is morally and contractually wrong?
(PS a speedy response would be welcome given the imminence of the court date)
