I am faced with a tenant who is contesting a small claims court judgememnt over 1000 in unpaid rent which the tenant is trying to offset with unsubstantiated repairs, furnishings and unsupported claims for injury.
The signed tenancy agreement is quite clear over the off setting issue which quite clearly forbids this action. Checks on the relevant Govt website also support my defence.
However, bearing in mind the bias against landlords, is there any precedent in law which can be quoted to override "off setting?"
Can anyone direct me to the law showing precedent for or against the landlord?
