My tenant is in rent arrears. Council paid lump sum as first instalment and now its a positive balance of around.166.00. And council wont pay the next instalment until end of next month --but contract is from 16th of the month.
Tenant is insisting to pay back the positive balance to her. I advised to the tenant that all the positive balances will be adjusted to following month.

1. Am I obliged to pay back to the positive balance to the tenant (which was paid by council)?
2. My tenant is arguing that the landlord cant keep the postitive balance.
My question is -
can i keep the positive balance and adjust accordingly for the next month ? Or if i cant keep the balance with me--then should i refund to council or tenant?
Please advice me.
