We have a 7 bed student house, with 1 joint tenancy for 5 people, and the other 2 rooms let on separate agreements. All tenants apart from 1 (they were in the group of 5) were students, and the council have made us, as the owner's, pay the full Council Tax due to 1 tenant not being exempt.

The RLA tenancy agreements are very clear that the tenants are liable for the council tax, and we have therefore deducted the money from the deposit of the group of 5.

The parent of one of the tenants is a lawyer and is very clear that in law the liability for C Tax falls with the landlord as its a multi let property.

My question is, does the tenancy agreement not override the fact that under the law the LL is liable for the C Tax, and thus we are correct in deducting the money from the deposit ?
