Substantial proportion of our portfolio consist of self contained flats - some up to 6 units - with a communal access available to all tenants and us as landlord to clean the area and service the alarm system etc. Without exception we have never had any issues as to questioning our right to have access to communal area - indeed it is essential that we do have unrestricted access

One particular tenant playing the system and complained to the council that we are entering the communal area without his consent ie harassment. The council has actually asked us for a 'licence agreement for communal area'!Although I can guess what it is, I feel the council is 'hair splitting'.

1.Are we suppose to have licence agreement with all our tenants? - it appears impractical and superfluous for such an obvious function
2. I feel the council is acting ultra vires interfering in such a way (?)
