Gas certificate

I have just had the gas appliances checked for the annual certificate. I have used a new gas safe engineer and he has qualified the certificate saying that the gas back boiler does not have a debris plate fitted, which has been a regulation for approximately 10 years and the cost of fitting this plate will be 165.

My query is that it has never been reported by other gas engineers (the system has been checked every year prior to letting my property) the system is over 10 years old and no other faults have been reported. When challanged the engineer said that it is up to me if we have it fitted but it does not conform to the regulations,

Can you tell me if I have a legal responsibility to have the debris plate fitted or is this just an observation?
