Good morning,

I have a tenant who inherited an Assured Tenancy from her late mother who had a protected tenancy. She is now behind for more than four months rent. She agrees with me that under her current financial situation ( she gets housing benefit) she will never be able to clear the backlog. However, if I write the arrears off, she will surrender her Assured Tenancy and take an AST simultaneously. Of course, it will open the door on my for Section 21 if need be.

My question is that :-

1. Is it possible for her to expressly give up her Assured Tenancy ? If so, is there a prescribed form or an official letter suffice.

2. Can she later on rely on her AT if for example I issue a Section 21 Notice?
