Hi, My tenant has just moved out owing some rent arrears. I sent her a new AST in May with an increase in rent to pay from 650 pcm to 680pcm.

She refused to sign the contract and I issued a section 21. She remained in the property and started to pay 680pcm but didnt sign the AST, so I allowed her to stay. She has now left without paying the last two months rent.

I am going to pursue her for the unpaid rent but does this need to be calculated at 650pcm as I do not have a signed contract for 680pm?
