Our tenant paid on time for the first few months, then fell further and further behind despite promises to pay and us trying to work with her with payment plans which weren't adhered to. The last 6 months she fell into over 2000 of arrears before eventually abandoning the property. We used a tracing agent to find her and went through moneyclaim online for the arrears plus costs. She opposed the claim saying the property was cold and damp and the window frames were rotten. The flat is on the first floor and the management company checked the window frames which are in poor condition saying condensation was the cause and suggested an extractor fan be fitted in the bathroom which would help. The tenant refused this as she had just decorated. All these events were put in writing by us including her refusals. The court date is set for the end of October and I am worried now we may liable for her costs plus humiliation at losing this case when we have been in the right and she is now using these condensation problems as an excuse not to pay as an afterthought. She also says she was overcharged rent for 2 years as we have now let it at 50 less per month.Do judges normally favour the tenant against a 'greedy' landlord when it is her word against ours? Has anyone any experience
