selective licensing

Hi all,
I've just had an interesting discussion with my local estate agent/letting agent regarding the introduction of selective licensing in Liverpool.

They told me that they are advising landlords not to pay it as the council will not be able to prove that a property has been let out unless 1) the landlord tells them or 2) the tenant is claiming housing benefit.

They also suggested that there is actually no legislation in place which gives them the power to investigate a property or impose a penalty for non payment.

Have any of you landlords out there who are already subject to licensing got a view on this?
