When I approached the guarantor for rent arrears she got a solicitor involved who claims she is not liable because
1 The Deed guaranteeing the liabilities was only signed by her and a witness, not by me as landlord of the property
2 The Deed was not signed at the outset of the AST, but when the Tenancy Agreement rolled over to become periodic. I did this to ensure that the guarantor understood that her responsibilities detailed in the tenancy agreement continued under the periodic tenancy
3 I did not carry out a "competent credit check". I established that she worked in a local shop by visiting her there, but did not approach any of the credit referencing agencies.
