Appointment of Lead Tenant
Dear Advice Team.
One of my properties is an HMO, housing a maximum of four individuals, one couple and two singles. The couple is named on the tenancy agreement but the singles - who change from time to time - are not. (For background information, it is my understanding that no HMO licence is required as 1) the number of tenants does not exceed four and the HMO is therefore classed as small with therefore no mandatory requirement and 2) there is no additional or selective licencing schemes in place).
I have appointed one of the couple as lead tenant (who supplied the deposit and pays the full rent by weekly transfer) and conduct all tenancy business through him alone - eg copy EPC's, right to rent checks and How to Rent guides are signed for by him alone.
Does this arrangement comply with tenancy law?
