I am now wanting to give my tenant notice, because of rent arrears.
She is on a Short Assured Tenancy agreement which expired on 8 January this year. I have deliberately allowed the agreement to continue on a month by month basis.

I think I have to give her 2 months notice is this correct? Do I need to use a solicitor, or would you recommend I use one?

I had previously enquired about this case, and learned from you that I could give her notice if she was at least two months arrears at the date of a court hearing. I did not pursue this approach, since most of her rent is paid by housing benefit, and I could not predict when the court hearing might be.
