We are purchasing a property with a tenant. We were told the tenant had signed a new tenancy agreement 1 month before the property was put up for sale. We have now discovered that the agreement was not signed and the tenant is now on a periodical agreement, we believe she may move out in the near future.
1... On completion of the property sale do we issue the tenant with a new AST, or does the original conditions of the old AST still apply. ie, can we serve her 1 month notice and can she do the same?
2... A deposit of 800 is currently being held by the letting agent. Can the letting agent pass the deposit on to us (assuming no deductions)on completion of the purchase?
3...Is there anything we should be aware of as we have never bought a property with an excisting tenant?
