Hi, I have a problem with a none paying tenant.

They have gone now, and I am chasing outstanding payment.

I have tried to follow the pre action protocol, sent formal letter of claim and a Without Prejudice offer.

Regrettably, rather than just starting the claim myself through the courts, I appointed a debt collector (I was not a member at the time).

After 5 months they say I need to reissue the formal demand and I should remove 1) section 8 costs, 2) rent whilst the property was being repaired (they trashed it, it took 26 days to sort and re let) and 3) I added 10% to cover my overheads as I organised it all etc.

I appreciate that a Judge has the right to award as they see fit, but am I entitled to any of these three items and why issue another formal demand? Advise would be much appreciated.
