A guarantor signed on behalf of a company. The rent is in arrears. We are in discussions with the company in order to obtain payment of these arrears. The company acknowledge the guarantor but claim the employee did not have the authority to sign on their behalf and state he is now in disciplinary proceedings as a result.

The company have offered us a small token payment as full and final settlement.

We believe that the guarantor was taken in good faith and want to pursue for the full amount.

Please can you advise should we be chasing the person who signed or the company or both?
