Dear RLA, Our elderly tenant has just passed away. His wife also died in January. They were the only named tenants and the rent was last reassessed by the tribunal around 4 years ago. They have had their Son living with them as a guest for the last few years, which we tolerated. We would like now to obtain vacant possession and wondered whether the Son has any legal right to remain? We could offer him an AST at the market rate but doubt very much if he could afford this. We are happy to give him a short period (say 3 months)to find alternative accommodation but wondered if he took over paying the rent he would be deemed the new tenant? Grateful for your advice. The flat needs renovation and this would be our preferred route of action and to let to new tenants.
