Rights of tenant non-smoker
What rights, if any, does a non-smoking tenant in a first floor flat have to stop the neighbour below smoking underneath their window or close enough to the building for the smoke to enter the first floor flat on a regular basis? Yes the tenant could close the windows, but why should they have to? Tenant has asked the neighbour politely to refrain from smoking directly under the window to which the response was 'my garden i'll smoke where i want' actually that one is rented as well, so strictly speaking not their garden.
Are there any regulations to stop the offending neighbour polluting or causing distress with their smoking?
