Hi

My friend's cousin (I'll call him "the owner") owns a leasehold flat in a building his father owns the freehold to.

When the owner went travelling for 6 months, he asked his dad to keep an eye on the flat - dad has a key.

When the owner returned he found a stranger in his flat. Stranger wouldn't let him in or even answer questions.

By this point the owner and his dad had fallen out and dad is refusing to disclose his arrangement with the occupier, so owner doesn't know if this person is paying rent under a tenancy (far less whether it's his main home or not so therefore AST or contractual tenancy) or if he's just there as his dad's guest or just paying nominal rent (under some type of licence agreement).

Naturally the owner wants his flat back ASAP - what would you advise?
