tenant has had a guarantor for a few years. Guarantor wants to be freed due to end of relationship with tenant. Tenant has offered to lodge a couple of months rent with agent as a buffer as expects earnings for next 12 months to be erratic and some month’s rents will be a bit short. Does this count as a deposit and, if so, does it need to be entered into the new tenancy agreement, placed with dps and ‘protected’ ? I will almost certainly be used up over the next 6 months or so.
