Really Worried about spurious Section 8 counter-claim
I am really worried about the situation with our tenants. We have issued a Section 8 halfway into a 12 month AST. Rent is already 3 months behind.
I am really worried about a few things, like whether our tenants could get Legal Aid and so rack up costs, and really worried about a last minute spurious counter-claim for disrepair. The tenants are not on benefits that I know of. Is legal aid likely?
Do counterclaims happen a lot? Surely to raise a disrepair counterclaim at least some evidence of having notified the landlord would be required? Do judges automatically allow them?
