Excluded license when only living at home 1 day a week

Can you use the standard lodger agreement excluded license when the landlord is only sleeping at the property 1 or 2 nights a week, however, retains exclusive rights to their own room still and shares rest of the house (bathroom, kitchen, lounge etc) and can call back and stay longer if they want to (IE: unlimited access) - as I need to work away for uni but want to "rent" out 2 bedrooms in my house out but keep it still as "mine" so I can come back weekends and/or holidays etc. My lodgers know I can come back/forth as I please and they have been "sold" the room as house sharers, but just want to be sure this is ok and I am not breaking the law.
