Hi, I have a tenant that paid 6 months in advance and then should have gone onto monthly payments. The 7th month he did not pay giving an excuse he sent the payment to his previous landlord. On the 8th month he paid (effectively for the 7th month). Thus he is still 1 month in arrears. I wrote to him asking him to inform me when he would be able to bring his tenancy payments up to date. He has ignored this request.
He should have mad a further payment today and so far has not.
My question is this:

Whether he pays for this month (late) or not, can I give him notice as he is in arrears by at least 1 month and has been now for 2 months.
Alternatively, should I serve him with the appropriate formal notice of eviction or am I still unable to do so unless he is 2+ months in arrears.

What is my position regarding this.
