I am a landlord myself, but am temporarily renting a studio in an HMO in central London. I signed an AST-agreement a couple of months ago with a property company who specialises in HMOs. I was in a great hurry to move when I signed the agreement for six months, and paid the two months' deposit. Within an hour after having moved in, I realized that the flat was both noisy and unsafe etc. and that I did not want to stay. I tried to convince the company to arrange for a swap, which they did not agree to.
My question is: in practice, what is likely to happen if I move out two or three months in advance, emptying the flat and giving back the keys with my immediate notice. Will they just keep the deposit and relet the studio, or will they take me to court.
No TDS is mentioned in the contract by the way.
