Hi, I have a flat in a house that has been converted into 4 flats on 3 levels. The flats have 199 yr leases and are all self contained. I let mine out to a girl claiming Housing Benefit. Rather than evict her as the HB didn't cover the rent, she managed to get someone to share with her and I changed the tenancy agreement to Room Share. They both claim HB and that has come through ok and covers the rent. When they tried to claim Council Tax Benefit the Council says that as the flat is classed as an HMO the council tax is charged to me. Are they correct on the HMO classification as I thought that applied to 3 or more sharing?
