Hi

I am working with the owner of a shop with a 4 bedroom flat above it. The shop owner rented the 4 bed flat on a 3 year AST to a single gentleman.

This gentleman then sublet the 4 bedroom flat to a family of 17 people. The owner was aware of this but had no involvement.

I'm trying to figure out who is now responsible for the conditions at the property, as it doesn't comply with the HMO management Regs.

So - under the Housing Act, who would a Local Authority pursue for failing to comply with the management regs? The owner, or the man who has sublet the flat?
