I hope you can help.
Our tenants have vacated leaving a 700 unpaid water bill. We have an 1800 deposit lodged with the DPS and would like to retain 700 and settle the bill to ensure it is paid. The tenants say they want their deposit back in full and will pay the water company but we are not confident they will do this.
Our tenancy agreement is clear that utilities including water are the responsibility of the tenant but it does not specifically say we can deduct unpaid bills from the deposit. Are we allowed to claim the deposit in this way to ensure it is paid and that no debts attach to the property? Is this something the DPS should accept?
