Tennants given back word

Not posted for a while but here we go.

Ive had a situation where a tenant gave me notice. I advertised as normal and found a new tenant who paid for a credit check and a 150 holding payment on the 3/9/15 on the proviso that they would be moving in on the 30/9/15.

On friday 18/9/15 the current (good) tenant gave back word an said she wanted to stay. As we all know, if the current tenant decided to dig their heals in it would take months to evict (not that i would do this as they are good tenants, they just changed their mind).

My question is where do i stand legally with the applicant. I of course gave them their credit check and holding payment fees back although they made quite a fuss about it all.

Could i be sued??
