HMO Planning??

I am currently converting a residential house to a HMO. i.e having fire alarms etc installed. The property is a 3 storie, 6 bedroom property and will be a house share by professionals. Bedrooms will be self contained but bathroom and kitchen facilities will be shared. My question is this. My HMO department of the local council have said that if I let any more than 5 bedrooms then I need planning and so suggested that I use the 6th bedroom as a office/lounge etc. The planning dept have said that regardless of bedrooms I need planning consent for a HMO. Have I just got an over zealous planning officer on the phone or do I need planning consent?
