Changing Rent Date

I have a 12 month AST. Rent is due on 28th of the month. However, tenant missed September payment. He has now paid, but says he does not get paid until the end of the month, so this gives rise to problems with the Standing Order.

He wants to pay on 2nd. I have no issue with him paying on 1st or 2nd. However, agent has suggested changing the rent date with an apportioned payment being made for the period 28th to 2nd.

My feeling is this could give rise to problems (a new tenancy because of the variation) and is at best messy when the tenancy expires and or if it runs into a periodic tenancy.

My inclination would be a side letter to say I will accept rent on 1st/2nd provided it is paid then. If not, I reserve right to have rent on the actual rent dates.

Any thoughts? Would either course of action prejudice me?
