Tenants have vacated the property 19 months into a 2 year contract. We had to change the locks to get unoccupied property insurance. We emailed the tenants to tell them this and ask for the return of the keys they hold but if they did want to continue with the tenancy and reoccupy the property they could and we would reinstate the old locks provided they paid up the rent arrears and continued to occupy the property until the end of the term. We confirmed as we were advised, to reiterate that we do not accept early termination of their contact by them returning the keys. They have refused to return the keys and claiming they can now sue us for illegal eviction. Although before they moved out they gave us one months notice and asked for early termination of their contract. We refused them this then and also in the email advising them the locks have been changed. Our intention is to sell the property but this can't now be marketed until next year. They have left the property with expensive repairs and redecoration to do to relet and we don't want to be the ones to end the contract. Our intention is to sit tight until the end of the contract in March 2016. Do we still have to serve a section 21 notice in January 2016 or as they have already left will this no longer be necessary, and can we just wait until the end of the contract. We do intend sueing them for breach of contract and the 5 months rent due to the end of the contract plus costs.
